Operated by Click Statement Inc., an incorporated company in Canada, doing business as Fitness Academy (“we,” “us,” and “our”). Click Statement Inc. owns and operates FitnessAcademy.com and the Fitness Academy app (together, the “Service”) and is the company responsible for your personal data. The Fitness Academy app is built on the FITR platform and delivered through FITR’s app infrastructure. This is the privacy policy that both our website and our Apple App Store and Google Play listings point to. Please read it together with our Terms of Service, Refund and Cancellation Policy, and Cookie Policy.

We are committed to protecting your privacy in compliance with applicable privacy laws, including Canada’s PIPEDA, the EU GDPR, and the California CCPA and CPRA, to the extent they apply. By using the Service, you agree to this Privacy Policy. If you do not agree, please do not use the Service.

Section 1. Age Requirement

The Service is not intended for anyone under 16, and we do not knowingly collect personal information from anyone under 16. If you believe a person under 16 has provided us with personal information, contact us at hello@fitnessacademy.com and we will delete it.

Section 2. Information We Collect

Personal Information. We may collect personal information when you:

  • register for an account;
  • purchase a product or subscription;
  • subscribe to our newsletter;
  • contact us for support;
  • participate in promotions or surveys.

Examples include your name, email address, billing address, and payment details (processed securely by Stripe, our payment provider, and not stored by us).

App and Training Data. When you use the Fitness Academy app, we may collect the account information and training data you enter, such as workouts logged, weights, reps, and progress over time. This data is processed and stored through the FITR platform so the app can deliver your training and keep your history.

Nutrition Data. This app may collect nutrition data from your device to provide personalized features and insights. Users have full control over which nutrition information is shared and processed by the app. Only the data explicitly authorized by the user will be collected. You can choose, at any time, which types of nutrition data the app can access and process. The app does not collect or use any nutrition data without your consent. All collected data is handled in accordance with applicable privacy laws and is used solely to improve your experience within the app. We do not use nutrition data, or any health related data, for advertising or marketing, and we never sell it.

Usage and Device Information. We may collect information that does not personally identify you, such as browser type, device type, operating system, IP address, and the pages you view and time spent on the Service.

Section 3. Cookies and Tracking Technologies

We use cookies, pixels, and similar technologies on our website to operate core site functions, analyze traffic (for example, Google Analytics), measure ad performance (for example, the Meta pixel), and remember your preferences. Section 4. How We Use Your Information

We may use your information to:

  • provide and improve the Service;
  • process transactions;
  • deliver your training and track your progress in the app;
  • respond to customer service requests;
  • personalize your experience;
  • send transactional emails related to your purchases;

  • comply with legal requirements.

We do not use health or nutrition data for advertising or marketing.

Section 5. Sharing Your Information

We do not sell your personal information. We share it only with the service providers we rely on to operate the Service:

  • Stripe (payments): processes and stores transaction and payment details.
  • FITR (app delivery): hosts and processes the app, including the account, training, and nutrition data you enter.
  • Meta, including Facebook and Instagram (advertising and analytics): receives website pixel data to measure and target advertising, where permitted.
  • Google Analytics (analytics): collects anonymous usage data about the website.
  • Email delivery and automation (Amazon SES and FunnelKit): send our transactional and marketing emails.
  • ManyChat (messaging): manages our Instagram and Facebook direct message conversations.
  • Hosting and infrastructure (Cloudways and Cloudflare): host and protect the website.

We may also share your information with professional advisers such as lawyers, accountants, and insurers where necessary; as part of a sale, merger, or transfer of our business, in which case the new owner would use your data under this policy; and with law enforcement or government bodies where required by law or to protect our legal rights. We require all providers to protect your data and to use it only for the purposes we specify.

Section 6. International Data Transfers

Some of our service providers process your information outside of Canada, including in the United States. Where applicable, we take reasonable measures to ensure your data receives a level of protection consistent with applicable privacy laws.

Section 7. Data Retention

We keep personal information only as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. We generally keep financial and transaction records for 7 years to meet accounting and tax requirements. We keep website backups for 30 days. When information is no longer needed, we securely delete or anonymize it.

Section 8. Your Rights

Depending on your location, you may have the right to access the personal information we hold about you, request correction of inaccurate information, request deletion of your information, object to or restrict certain processing, request a copy of your data in a portable form, and withdraw consent where processing is based on consent.

Account and Data Deletion. You can delete your account at any time from within the Fitness Academy app. You can also request deletion of your account and associated data by emailing us at hello@fitnessacademy.com. You can unsubscribe from marketing emails using the unsubscribe link at the bottom of each email.

To exercise any of these rights, contact us at hello@fitnessacademy.com. We may verify your identity before processing a request, and we aim to respond within 30 days.

Section 9. Data Security

We use commercially reasonable safeguards to protect your information from unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage is fully secure, so we cannot guarantee absolute security.

The Service may contain links to third party websites. We are not responsible for their privacy practices. Please review their privacy policies before providing personal information.

Section 11. Changes to This Policy

We may update this Privacy Policy from time to time. The “Last Updated” date above will reflect the most recent revision. Your continued use of the Service after changes are posted means you accept the updated policy.
